I love Turf Battles, even the way it was but look here, but so far it looks like it's going to fail.
Right on the end of the giant wall of text. Which you should read and perhaps start paying attention to ToSs more now before signing away your rights digitally and agreeing to anything the company demands from you. They're basically saying don't take their word on anything because it probably won't be happening unless their ToS allows for it to happen. Nothing on their website is guaranteed to be true. Same goes for everything they say. That they don't *have* to fix any errors like bugs. They've spent years building this baby up, the earliest copies I found were only from 2007 and dozens of changes happened over the years. YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM AGE OR THROUGH OR FROM THE WEBSITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF USE. (b) AGE AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO WARRANTY THAT (i) THE WEBSITE WILL MEET YOUR REQUIREMENTS; (ii) THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE WEBSITE WILL MEET YOUR EXPECTATIONS; AND (iv) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. I'd be very interested to hear a lawyer's or a law school student's opinion on their terms of service. Anyone like that on OnRPG? The terms are subversive in nature at beast. They really wound up the protection from everything, like refunds, having to provide any kind of quality product/service, having the right to do anything to anyone they want. Haven't they ever heard of human rights? How well would a legal contract like this stand up? Especially given the fact that so many people wouldn't be able to understand it all? I myself am having trouble working out some of the things they state and how they state them. An idea had occured to me, if any German and French players want to help out and spread the word about Aeria games, it would be great. Don't be rude or force your views on them but show them and let them choose for themselves. They recently moved over to Europe I read, starting up over there. If they can be shut down for their dirty business practices and their totalitarian terms and their subpar services, everyone would be better off. I'm going to try and file an investigation to see what they do with our private and not so private data, how many people have access to it and things like that. For all we know they could be making an extra back selling all the data they acquire to 3rd parties like marketing companies. And due to the wording in their ToS they can get away with it, if that contract can stand up in court. Last edited by Xenus.; 04-15-2009 at 10:15 PM. Reason: forgot to finish my train of thought! |

I liiiiiike it. I really don't like Aeria or IGG for quite a few reasons, there's very few companies I like. The only company I'm not bugged to death by is Nexon.
*EDIT* Reading Aeria's ToS, holy crap...that's...awful.

I love these companies since they make sure you don't go to any bad quality games and protect you by deleteing any posts mentioning those other bad games you see. Thank you Aeria, good job.
If you think that wasn't sarcasm, your crazy |

As for ToS, Its normal for something like this " Your accound can be suspeded without notice" Or like many other ways of telling this. All proffesional P2P games have it, (I think all F2p's too but there are too many to check) |

This is normal;
We Reserve the Right to Refuse Service to Anyone. This is not. AGE MAY SUSPEND, TERMINATE, MODIFY, OR DELETE ANY ACCOUNT AT ANY TIME WITH OR WITHOUT REASON, WITH OR WITHOUT NOTICE. Who gave them all these rights to do all these extraordinary things? Apart from the people who click I accept the terms and create accounts. (I still have serious doubts as to the legal nature of their ToS) And just because you tell someone you reserve the right to refuse someone service, doesn't mean it's completely legal and justified.
