No, he probably can't, but you also can't prove that they didn't buy the rights so why don't we all just shut the hell up because it's not like this will affect how fun/shitty the game will be anyway. And besides that, how the hell do you expect someone to find proof of something like that? It's not like they announce over the internet that they bought the rights to use game sprites...because
