i cant install it onto my 2gen touch for some reason, it says it requires the iPhone 3.0 software

I bet apple made some of these app's require 3.0 update just so they wud get paid.

Download the ipod firmware of your choice online.
Go to itunes.
Shift+Click Update.
Choose File.

Problem solved.
