One punch doesn't give you the right to defend yourself, walk away. If he is constantly attacking you then it will be considered self-defense, but if your using one punch as a reason to attack them back then no that's not self-defense.

Think of it this way, if someone randomly punches you once and you attack them back. That won't count as self defense because you can walk away, like I said, if he chases after you, then obviously you are in danger and able to use "self defense". You punching him back when he only had the intention of punching you once will instigate another punch leading to a fight, that's why it isn't self-defense. Self-defense is used as a last retort, not a reason to pound the other person back without getting in trouble.

P.S. if someone hits your friend and you hit them back, you'll obviously get in trouble because he did not do any harm to you so technically you punched him first. You have to use common sense in this situation.

anyway, that was a bad story and unlucky that it happened to your brother. but if people are going to be random *ssholes then realistically what can you do? even if the guys got punished and even if you shoved so much litigation into their *sses that they dont even have a pot to piss in it still wont make any difference. sorry to hear about what happened to your brother but i guess its what you would call Sod's Law. people sometimes like to exercise their right to be bastards, i dont ever see that changing. but its good that your brother didnt get badly hurt because this story could easily have had a far worse ending.
