Unfortunately Dennis is right. Me, personally, I have no objections. Looks good! Very impressive, I must say.
But it's true that it will get shut down... there's no two ways about it.
Sucks, I know... the only way to get around a C&D letter from Nintendo would be to write to them now and ask for permission. Chances are it'll be no, but at least it gets the whole thing out of the way before you're even farther along and they stumble upon it and get pissed because you've been doing it in secret. Sorry
