I'm pretty sure most closed beta games that link in with multi-MMORPG companies do not have an NDA on their closed beta games. Why would they want an NDA? If they are a lesser-known company, they need as much promotional advertisement as they can get, and showing off in-game screenshots can be one of the many ways of casually doing that, benefiting both parties.

Not really, It's mainly the style. But the game was made AGES ago, can't really expect great graphics there.
