Actually, if it was real, the counter-suit would fall through, as the store could argue that his "rudeness" was interfering with their bussines, possibly causeing them to loose money.

A store cannot ban someone based on race, but they can ban someone based on how they act. (It's like the policy, "No shirt, No Shoes, No Service")
