    Default Police Beat Homeless Man to Death

    Yes it's another topic about cops abusing their power.

    Not a lot of info on the story.
    It is said that the homeless man (who was mentally ill) was caught burglarizing a vehicle.
    5-6 cops tased and beat him to death.

    There is also footage from a cell phone where you can hear the homeless man yelling "Dad Dad Dad" while the cops repeatedly beat him.
    His father is a retired police officer too so I wonder what he thinks.

    After all this evidence 5 of the cops are just transferred and another is on administrative leave.
    That is hardly a punishment.
    If a normal citizen did this they would be in prison for years to life.

    Of course not all police officers are like this but I think their should be stricter rules on who can become a police officer and much more severe punishments for those who are police that commit crimes.

    what is it with cops and beating people ***? I remember back when i was 14, some kids spray painted some gang shit on the bathroom wall at the park. So a cop rounded me and 3 of my friends up and beat us with phone books
    We weren't even involved. The reason they said it was us? Because I had some heavily starched JEANS

    Heh nothing new back in the day i got couple of punches from cops with my friends ... Like few times it was ****ed up but they did so that nothing could be seen :/

    Lol and they want to make it illegal to film cops in public bullshit.

    I doubt they will get a punishment that fits the crime.

    If a normal citizen beat a cop to death he would probably get life.

    Some cop's just have that macho man "imma rid the world of disease" attitudes.

    In this case, its sad it happened. But worse things are going on then a homeless man getting beat to death. Anyway, who knows what that dude did to get where hes at. Im not judging the dude, but im fairly certain he would feel the same if he was sitting here reading about my death. Plus, Ive heard of whole squats getting burned down by cops before. Yeah, a house full of homeless kids burnt to the ground, no warning or nothing

    This world has always been ****ed up. Sometimes i think we should go back to stoning people in public, so we visually get to see how brutal punishment can be. Not just, send me to my cell with my bed and warm meals. Sure, your butt gets touched here and there, but you'll learn to enjoy it. Pretty fine trade for a warm meal and a place to sleep. Bums get the same butt treatment, with harsh winters and some good ol' fashion starvation.

    Isn't this why you have Citizen's arrest? Isn't this considered aggravated assault? There were people standing by and they did nothing...

    It's after he was beaten to death.

    It's not heavily gruesome but it is something that some people might not want to see.

    Sad state of affairs. I doubt cops even know the law themselves, but people rarely stand up to them because these days they can arrest you for almost anything. "Breach of peace" is my personal favourite.

    Why cant this world have any federal department, or a government thats A: Uncorrupt or B: Doing their job well. Its annoying that people are power hungry when theyre just cops! They treat everything like a code red.

    The police over here don't even have the balls to hit people. If you get them angry, the only thing they do it trying to make you scared, by putting some handcuffs on, and take you to the police station to sit in their 'jail for a few hours. They also like to lie to make you even more scared. I once fell for those stupid pranks of them

    You can not citizen arrest a police officer.
    That's not a legal possibility, the law doesn't think of such situations.

    I doubt it would have done any good and it would have been very courageous as a sort of a symbolic act.

    It doesn't work that way though, the citizen arrest doesn't make you higher than the organs of the law who are under order which warrants their authority to act by the authorization of the state.
    You can't turn him over to the authority of the state, he is the authority of the state. This does makes it impossible for anyone to constrain a police officer, aside his superior. (Any high ranking officer can technically be relieved by a subordinate, or a superior. The patrol cop is basically untouchable as long as he is on patrol. The idea is to give an officer so much power in procedure, that he will never have to resort violence, which is strongly regulated. With bad cops, that already bring a bad disposition, it sadly increases both.)

    The laws concerning "Citizen's arrest", which vary from state to state, make no special provision making police officers immune.

    Citizen's arrests are always discouraged and can leave the person doing it open to all sorts of suits using "strict liability", ie., you better be right, and no one better get hurt!

    However, if you personally observe someone committing a felony you can in theory arrest them whether or not they are a policeman.

    The most common instance of citizen's arrests of policemen is for shoplifting. When a store catches a shoplifter and their security arrests the culprit that is a citizen's arrest. From time to time a policeman is caught.

    He is not imune in that the law says " 2, III police is immune though"

    He is immune in the sense that it says:
    Has to be turned over to the authorities as soon as the possibility arises and before the next XX hours are due. *)

    The possibility arises immediately; He is the authorities.

    You can have a shot if
    - You make good use of the situation
    - The cop is some old not very sharp fellow who hasn't wasted a second thought on the law since his training
    - The cop get's overwhelmed by the fact that he is forced into being apologetic beforehand.

    Not when he is in the act of enforcing one of his authorities.
    He will either see you eff off, or you will get it.

    I am not 100% up to american law or much less state law, but I know how police work works out. I had to learn the laws in concern by hard and to be able to interpret them as a part of my military specialized training and enforce it as a part of my "job" daily for quite a while.
    It's not something that is possible, by the nature of the job.

    You might get a job-bored police man off-guard, but that's a risk to bet against getting maimed.

    *) This has a lot to do with the human rights declaration and avoiding paramilitary state police acts and such and ensuring due procedure, so it's not an optional part or going to be severely different internationally. In the laws concerning arrest it's the weakest option. However policemen will know about it for sure, because under certain circumstances it's a better idea to do a citizen arrest than to arrest in the person of being a police officer (least paperwork, least problem if improper, lowest profile so to speak). It's severely limited though, because it cuts time until release short, if there is no accusation brought before a court by the federal attorneys.
