Stealing wifi.. Can't get caught

Most router's software will log the computer name, MAC address, and much more of the systems that connect to it.
There have been people before that got convicted of this, and it can happen again.

Is it still illegal if say.. you live in an apartment above a cybercafe and leech of their free wifi?

(This is hypothetical! I do not live above a donut shop)

And MAC addresses are used to identify systems. If they are able to get ahold of your system, they can check if it was your system or not, and you can't change the MAC address on your system(you can spoof it sometimes, make it seem different to the out-side world, but not actually change it on your system)


Now, exactly how they locate them, I don't know, but it has happened quite often these days, so theres got to be some way that they are doing it.
