    law is complicated...im studying it going for my BA and then off to law school...this can and does happen even though it is unjustl.l..but 2 & 1/2 years? thts just stupid. I mean look at the circumstances..what was the judge or jury thinking

    Maybe they were thinking that beating a guy to near death when he is on the ground and no longer a threat isn't self defense?

    The fact that the op doesn't mention that the burglar was out in the street and running away from the defendant when he got struck is pretty important I think, before you all go leaping to his defense. Once the burglar is on the run, the correct thing to do would have been to try and apprehend him, rather than getting him to near death.

    However, I think the fact that the burglar escapes jail for tying up the defendants family and threatening them with knives is absolutely sickening. You can be arrested for just carrying a knife, let along threatening with one, so why did he escape jail?

    but yeah, because of the nature of the case alot of people are getting caught up in a witch-hunt for revenge, rather than justice.


    systems of law are not just about punishing people for committing crimes, they are about preventing crime too (and not just through deterrents)

    so like whats the point in convicting someone for a crime, giving them a sentence but then sticking a bit more on the end just because you feel that "he has to get what he deserves"

    once someone has been convicted and sentenced by a court of law, then thats that. unless other evidence comes to light. if someone isnt a danger to society why should they be kept locked up longer just because some of you feel "yeah hes an *sshole, you can tell by looking at him"? its stupid.

    this isnt political correctness gone mad and it isnt stupid law courts being stupid. this is an isolated case blown out of all proportions but honestly that asian guy is lucky he didnt kill the burglar.

    caving in someones head in the street with a blunt object isnt something anyone should expect to be able to walk away from lightly, NO MATTER how drunk or angry or drugged or insane you are.

    but yes each case needs to be looked at on its individual merits. personally i think the sentence against the victim is just. but i think the burglar should have had a more severe punishment given that he was weilding a knife. but lets not all jump on the "its a bloody outrage!!!!" bandwagon and make ourselves look foolish.
