It would cover men who shout at their wives and women who hurl abuse at their husbands - although it was not clear last night if nagging would be viewed as breaking the law.
The law is expected to cover every kind of insult including repeated rude remarks about a partner's appearance, false allegations of infidelity and threats of physical violence.
Police are being urged to issue a caution in the first instance, but repeat offenders could face a fine, a restraining order or even jail.
Critics said the measure was a gimmick produced in response to lobbying by feminists and would be impossible to implement.
But French premier Francois Fillon, who announced the law, said: 'The creation of this offence will allow us to deal with the most insidious situations - situations that leave no visible scars, but which leave victims torn up inside.'
Many believe the offence will be impossible to prove. Psychologist Anne Giraud said: 'Squabbling couples will allege all kinds of things about each other, but often it will be a case of one person's word against the other.'
Sociologist Pierre Bonnet said: 'The next step will be to make rudeness a criminal offence. The police and courts will be over-stretched trying to deal with numerous cases.'
A spokesman for Mr Fillon said the law was supported by the government, and was likely to be implemented within six months.

Under this new law, so much as making a negative comment concerning one’s wife’s appearance could lead to the husband being fitted with an electronic monitoring device, such as the leg bracelets attached to criminals in the US. If anything symbolizes slavery, it is these modern day manacles and leg irons.
This law only criminalizes insults within cohabiting relationships, so men are still free to offend women in France, provided they aren’t living with them. The legislation surrounding family law in the West has become so oppressive and so insane that it is a wonder young men still get married at all. We all know that women, at certain times [of the month, often], are prone to call anything abusive and to take offense at the slightest and most trivial of innocent words or gestures, so the law constitutes a very real threat to any man who gets married.
One can imagine thousands of French men being hauled into court as a result of a fleeting moment in their wives’ tearful affliction with PMS, then sternly admonished by a judge and outfitted with the accoutrements of slavery. Surely, this should convince men that marriage is to be avoided like the plague, entered into only by the most troubled, masochistic souls or benighted fools of the highest order.
The question this raises is whether women really are interested in marriage. All of the evidence points to the fact that they are, but still one finds them working like busy beavers to topple the institution and chase any men with an ounce of sense away from it. One has to ask whether women are really this fundamentally stupid as to undermine their own interests to this extent. Laws such as these give us legitimate cause to wonder about that.
