But just imagine their legal fees... ouch. Microsoft aren't really known to be tight fisted when it comes to legal representation.

The family sued them because a faulty xbox cord killed their baby. Microsoft ADMITTED to this fact 3 months later and started the exchange program. They're not pushing the blame on anyone, it was Microsoft's fault because they can't make hardware worth a damn.

erm what was an infant doing with a 360? and to think the infant over heated it. usually most xbox games are rated M and an infant should barely be able to grasp the controller. i think maybe its the parents fault for even leaving the 360 on long enough to overheat and even letting the infant to play with it.

-The baby wasn't playing it.
-The Xbox didn't overheat. The cord was faulty and was known(to Microsoft) that it could cause dangerous fires.
-They're counter suing because they fell it makes them look bad. They shot themselfs in the foot really badly because they're counter suing a family who was a victim of shady dealings done by Microsoft regarding the issue.
-It took them 2 months after Christmas 2004 and this issue(Holiday Season) to alert the owners of said issues.

Microsoft has now officially responded to an Illinois family's lawsuit in which a fire was allegedly caused by a faulty Xbox console in December of 2004. The fire resulted in the death of an infant, Wade Kline. According to the lawsuit, the fire was caused by an overheating power supply, which became so hot as to start the deadly fire. Microsoft, in response, has stated that the fire was wholly the responsibility of the family, and that it was the result of "misuse or abuse" of the console in question. Furthermore, Microsoft claims that the fire was the result of an "obvious" condition of which the family was aware. Considering Microsoft did not recall power cords until February of 2005 (on account of fire concerns) we're not sure to what obvious condition Microsoft is referring. Microsoft had been covering the issue up prior to the event(just like the Red Rings of Death) now. If Microsoft had recalled the cord when problems began then the child would be alive. They hid the facts to avoid losses in the Holiday quarter.

Yes, a power cord can cause a fire. It has an electrical current running through it (its called an electrical fire).
The baby wasn't playing the freakin game (and that's the dumbest reply I've seen yet). The console caused a fire, the fire then killed a baby (seeing as how fires tend to do that... whether you're playing a video game or not).
Microsoft knew about the issues and admitted it later (hence the recall).
Therefore, Microsoft is to blame.

ANyone heard about the guy who sued a trailer(forgot name of the big vehicles that you can wlak in) becuase they didnt say in the manuel if you leave cruise on that it wont go straight so he leaves vehicles on cruise and goes to get coffee WHILE on teh highway. That was Darwinism at its finest (sadly, he didn't die), but this is not the same thing. Most every appliance can (and is often designed to) be left on 24/7. And NO appliance should start a fire just from leaving it plugged in. That's faulty manufacturing and illegal.
